Website terms of use

These are the current Terms of Use and they replace any other Terms of Use for the TelstraSuper website which have been previously published on the TelstraSuper website.

The TelstraSuper Website (Website) is owned and operated by Telstra Super Pty Ltd ABN 86 007 422 522, AFS Licence No. 236709 (Trustee), the trustee of the Telstra Superannuation Scheme (TelstraSuper) ABN 85 502 108 833 under the domain name, www.telstrasuper.com.au.

The Website Terms of Use are current as at 31 January 2017 and replace any other Terms of Use that have previously been published on the Website. The Website Terms of Use apply whenever you use the Website.  By using the Website, you acknowledge that you have read, understood and accepted the Website Terms of Use.

In addition to the Website Terms of Use, specific Terms of Use may apply to other parts of the Website including SuperOnline, TelstraSuper’s secure member portal and the TelstraSuper Direct Access Investment Platform.  To the extent of any inconsistencies between the Website Terms of Use and the specific Terms of Use, the specific Terms of Use will prevail.

The Trustee may modify, suspend, discontinue or restrict the use and availability of the Website at any time without notice.  The Trustee does not guarantee that the Website will be free from computer viruses and other harmful code, or that access to the Website will be uninterrupted.

Changes to the Website Terms of Use

As the Trustee anticipates that the Website will be enhanced on a continual basis, it may at any time amend the Website Terms of Use. You will be given notice of any amendments to the Website Terms of Use by the Trustee publishing the amended Website Terms of Use on the Website.

You acknowledge and agree that when the Website Terms of Use are amended that the Trustee has provided you with sufficient notice and that any subsequent access to the Website by you constitutes an acceptance by you of the amended Website Terms of Use. The Trustee recommends that you periodically check the Website to review the current Website Terms of Use.

The information on the Website has been provided by the Trustee in good faith and all reasonable care has been taken to ensure that it is accurate, current and complete.   However, as superannuation is complex and subject to change from time to time, the Trustee reserves the right to correct any errors or omissions in the information.

The operation and management of TelstraSuper is governed by superannuation, taxation and related legislation, and the TelstraSuper Trust Deed. To the extent of any conflict between the information on the Website and the Trust Deed, the Trust Deed will prevail. 

Any general advice on the Website has been prepared without taking into account your objectives, financial situation or needs.  Before you act on any general advice on the Website, you should consider whether it is appropriate to your personal circumstances. 

Before making any decision in relation to your TelstraSuper account or becoming a member of TelstraSuper, you should read the relevant product disclosure statement which is available from www.telstrasuper.com.au/Tools_and_forms or by calling 1300 033 166 between 8.30 am and 5.30 pm (AEST) Monday to Friday. 

The performance of the investment options referred to on the Website is not guaranteed by the Trustee or the relevant investment managers. The value of investments may rise and fall with changes in the market. Past performance is not a reliable indicator of future performance.

Limitation of Liability

Except for any liability that cannot be excluded by law, the Trustee, its directors, officers, employees and related bodies corporate exclude any liability for any loss, damage (including any consequential loss or damage), claims and expenses (including but not limited to legal costs and defence or settlement costs) suffered or incurred by you directly or indirectly arising out of or in connection with the Website whether in contract, tort including negligence, statute or otherwise.

The Trustee’s liability for any breach of any condition or warranty implied by law and which cannot be excluded is limited to the maximum extent permitted by law.

Indemnity

You indemnify and hold the Trustee, its directors, officers,  employees and related bodies corporate harmless from any claims, liabilities, costs and expenses, (including but not limited to legal costs and defence or settlement costs) incurred directly or indirectly in connection with your use of the Website.

When you visit the Website

Anonymous information is collected about you when you visit the unsecured part of the Website to read or download information.  This information includes the date, time and duration of your visit, the pages viewed, any documents downloaded during the course of your visit, the type of browser used and your internet address.  You are not able to be personally identified from this information.  The information collected is used in an aggregated form to give the Trustee an indication of the volume of visits to the Website.  From this information the effectiveness of the Website can be gauged and its usability monitored and improved.
If you use any of the tools available on the Website, such as an interactive worksheet or calculator, the calculations will run on your computer or on the TelstraSuper server.  If the information is run on the TelstraSuper server, any personal information that you enter when using the tools will be captured for the duration of your visit.  This is to assist you as you input information during the course of the calculation and saves you from having to re-enter all of your details if you wish to alter any inputs to any particular calculation field.  Any personal information you enter on the Website is cleared on a time out basis.

Cookies

The Website currently uses cookie technology to enhance your usage and the functionality of the Website and to identify and remember information or benefits, features or services that may be of interest to you (based on your usage of the Website).  A cookie is a small text file that our Website may place on your computer's hard drive in order to allow the Website to identify your computer.

The use of cookies does not result in the collection of any information that enables you to be identified or the transfer of any of your personal information to a third party. 

The cookie allows for recognition of such things as information you have entered, pages you have previously visited (or not visited) or features of the Website you have used (or not used) to facilitate easy access to relevant information on the Website. You can adjust the settings on your internet browser to manage, disable or block cookies. However if you do this, you may not be able to access certain areas of the Website.

Any personal information collected by the Trustee when you use the Website is handled in accordance with the Trustee's Privacy Policy and Privacy Collection Statement.

The Website contains links to websites operated by third parties.  These links are provided for convenience only. The Trustee makes no representations or warranties in relation to the suitability, accuracy, currency or completeness of the information on third party websites.

In providing links to third party websites, the Trustee is not recommending or endorsing any products or services of the third party. You should use your own judgement before taking up any products or services from the third party. 

The Trustee, its directors, officers, employees and related bodies corporate are not liable for any loss, damage (including any consequential loss or damage), claims and expense (including but not limited to legal costs and defence or settlement costs) suffered or incurred by you arising from or in connection with your use of third party websites including any information accessed from those websites and any products or services of the third party.  

Reasonable Use

You agree to use the Website and its contents for your own personal use. You must not use this Website in a manner that infringes the intellectual property rights of the Trustee or for a purpose which is unlawful or inconsistent with the Website Terms of Use. 

You agree to not reproduce, store, modify, adapt, reverse engineer, decompile or disassemble the Website or any of its component parts without the prior written consent of the Trustee.

You must not use this Website in a manner that defames, harasses, unlawfully offends or harms any person. Your use of the Website may be varied, suspended or cancelled at any time by the Trustee without notice. You acknowledge and accept that the Trustee will not be liable for any interruption, variation, suspension or cancellation of the Website.

Copyright

Except where otherwise stated, the copyright and intellectual property rights of the information on the Website is owned by the Trustee. Other than as permitted under the Copyright Act 1968 (Cth) no information or materials on the Website may be reproduced, stored in a retrieval system or transmitted without the prior written permission of the Trustee.

TelstraSuper, TelstraSuper Financial Planning and SuperOnline, RetireAccess are registered trademarks of Telstra Limited.  BPAY is registered trademark of BPay Pty Ltd. You agree not to reproduce or use any of the trademarks displayed on the Website.

Governing Law

The Website is provided for use by Australian residents only. The Website Terms of Use are governed by and to be construed in accordance with the laws of the State of Victoria, Australia.
